2. Collection and storage of personal data and the nature and purpose of their use
a) When visiting our website:
MINT Gallery (or its webspace provider) collects data about every access to the offer (so-called server log files). These access data include: Name of the accessed website, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, the user's operating system, referrer URL, IP address and the requesting provider.
MINT Gallery uses the log data only for statistical analysis for the purpose of operation, security and optimization of the offer and reserves the right to subsequently check the log data if, based on concrete evidence, there is a justified suspicion of illegal use.
b) For orders and when concluding memberships:
In the context of membership and purchase contracts, MINT Gallery will collect contractually relevant personal data which will be stored and used for the purpose of fulfilling the contractual relationships. This data is collected, used and passed on exclusively in congruence with the points described in 3.
c) When contacting us by email:
When contacting MINT Gallery by email, your data will be stored for the purpose of processing your inquiry and in case follow-up questions arise.
d) When registering for our newsletter:
With the newsletter MINT Gallery informs about its exhibitions, events and offers. In order to subscribe to the newsletter, a valid email address and information that allows verification that the owner of the email address provided agrees to receive the newsletter is required. This data is stored by the mail distribution service Artlogic, which MINT Gallery uses for sending the newsletter. When you register for the newsletter, the IP address and the date of registration are also saved. This storage serves solely as proof in the event that a third party misuses an email address and registers to receive the newsletter without the knowledge of the entitled person. Consent to the storage of the data, the email address and its use for sending the newsletter can be revoked at any time and relevant changes can be made.
3. Handling of personal data
Your personal data will only be transferred to third parties in the following cases:
a) if you have given your express consent in accordance with Art. 6 para. 1 sentence 1 lit. a DSGVO,
b) if the disclosure pursuant to Art. 6 para. 1 sentence 1 letter f DSGVO is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
c) in the event that there is a legal obligation to pass on the data pursuant to Art. 6 para. 1 sentence 1 lit. c DSGVO, and
d) this is legally permissible and required for the processing of contractual relationships with you in accordance with Art. 6 para. 1 sentence 1 lit. b DSGVO
4. Cookies
MINT Gallery uses cookies on its website. These are small files that are automatically created by the browser and stored on the end device (PC, laptop, tablet, smartphone or similar) when a page is visited. Cookies do not cause any damage on the end device, do not contain viruses, trojans or other malicious software. Information is stored in the cookie that is related to the specific terminal device used. However, this does not mean that the identity of the user is revealed. Cookies are primarily used for the user-friendliness of websites and thus for the users (e.g. storage of login data). On the other hand, they are used to collect and analyze statistical data on website usage. Users can influence the use of cookies. Most browsers have an option to restrict or completely prevent the storage of cookies. However, this can restrict the use and especially the comfort of use.
5. Rights of use
The persons concerned have the right:
a) to request information about their personal data processed by MINT Gallery in accordance with Art. 15 DSGVO. In particular, they may request information about the purposes of processing, the category of personal data, the categories of recipients to whom their data has been or will be disclosed, the planned storage period, the existence of a right of correction, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of their data, if not collected by Super Super Markt, as well as the existence of automated decision making including profiling and, if applicable, meaningful information on the details of such data;
b) pursuant to Art. 16 DSGVO, to demand without delay the correction of incorrect or incomplete personal data stored by Super Super Markt;
c) in accordance with Art. 17 DSGVO to demand the deletion of their personal data stored at Super Super Markt, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
d) pursuant to Art. 18 DSGVO, to demand the restriction of the processing of their personal data insofar as the accuracy of the data is disputed by them, the processing is unlawful but they refuse to have it deleted and MINT Gallery no longer requires the data but they need it for the assertion, exercise or defense of legal claims or they have lodged an objection to the processing pursuant to Art. 21 DSGVO;
e) in accordance with Art. 20 DSGVO, to receive their personal data which they have provided to MINT Gallery in a structured, common and machine-readable format or to request that it be transferred to another responsible party;
f) in accordance with Art. 7 para. 3 DSGVO to revoke their consent, once granted, to MINT Gallery at any time. As a result, MINT Gallery may no longer continue to process the data based on this consent in the future
g) lodge a complaint with a supervisory authority in accordance with Art. 77 DSGVO. As a rule, they can turn to the supervisory authority at their usual place of residence or workplace.
6. Right of objection
If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1, sentence 1, letter f) DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, if there are reasons for doing so arising from your particular situation or if the objection is directed against direct marketing. In the latter case, you have a general right of objection, which will be implemented by MINT Gallery without specifying a special situation. If you wish to exercise your right of revocation or objection, an email is sufficient.
7. Data security
MINT Gallery uses the SSL procedure (Secure Socket Layer) in connection with the highest level of encryption supported by your browser. As a rule, this is a 256-bit encryption. If your browser does not support 256-bit encryption, 128-bit v3 technology is used instead. You can tell whether an individual page of the website is being transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser.
MINT Gallery also uses appropriate technical and organizational security measures to protect your data against accidental or intentional manipulation, loss, destruction or unauthorized access by third parties. The security measures are continuously improved in line with technological developments.
